Overtime Pay Requirements

You must be paid one and a half times your 'regular rate of pay' for each hour you work over 40 in a work week - unless you are 'exempt' from overtime for one of the reasons set forth below. Payment must be in cash, not in "time off" or some other form of compensation.

There are two requirements that must be met for you to be considered 'exempt' from overtime.  First, your employer must pay you a salary of at least $455 per week or $23,660 per year.  If you are paid less than that, you are automatically entitled to overtime pay.

If you are paid a salary of at least $23,660, then your employer may not have to pay you overtime wages if your work involves one of the following types of work (click on each category for a more detailed explanation):
