Salary Test:  if your salary is less than $23,660 per year (or $455 per week) you are automatically entitled to overtime regardless of your title or duties.  If your salary is more than $23,660 per year, you meet the 'salary test' and may not be entitled to overtime wages IF your work involves the type of duties set forth on the previous page.

Your primary job duty (not your title) determines if you are entitled to overtime:

  • Even if you are paid a salary of more than $23,660 per year, but your primary duty is not an ‘exempt’ position, you are entitled to overtime.

Example: 

  • Sally is a receptionist.  She earns $30,000 per year.  She works 50 hours per week.  Sally must receive overtime pay for every hour over 40 per week because her duties do not fall within one of the exemptions.
  • Paul is a manager who oversees the work of several employees.  He is paid $45,000 per year.  Paul is not entitled to overtime wages because he meets the salary test and his work is considered 'managerial' in nature.
  • Jim is a manager who oversees the work of one other employee.  He is paid a salary of $45,000 per year.  He is entitled to overtime because, even though he meets the 'salary test', he does not qualify for the 'manager' exemption because he does not supervise two or more employees.
